Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and VegaHouse LLC ("we", "us") governing your use of the Alpen application ("Alpen"). By downloading or using Alpen you agree to these Terms. If you do not agree, do not use Alpen.

1. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Alpen on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, redistribute, sell, reverse-engineer, or attempt to extract the source code, preset files, or template definitions from Alpen, except where that restriction is prohibited by law.

2. Your content

Your photos and videos remain yours. We claim no ownership of anything you import, edit, or export. Alpen processes your images entirely on your device — we do not receive, store, or have any access to them.

You are responsible for having the rights to any image you edit, including permission from people who appear in it.

3. Presets, templates, and outputs

The presets, colour profiles, templates, overlays, typography arrangements, and other creative assets in Alpen are our intellectual property or are licensed to us, and are provided to you under the licence in section 1.

You may use images you export from Alpen for any purpose, including commercially — client work, sponsored posts, advertising, print. You may not extract, redistribute, resell, or repackage the presets or templates themselves, whether as files or as part of another product.

4. Subscriptions

Alpen offers a free tier and an optional paid subscription, Alpen Premium, which unlocks the full preset and template library and ongoing content releases.

• Payment is charged to your Apple Account at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription in your Apple Account settings. Deleting Alpen does not cancel a subscription.
• Where a free trial is offered, any unused portion is forfeited if you purchase a subscription before the trial ends.
• Refunds are handled by Apple under their policies, not by us.

We may change subscription pricing. Changes will not affect the period you have already paid for, and Apple will notify you as required before any change takes effect for a renewal.

5. Promotional and complimentary access

We may issue one-time access codes granting Alpen Premium for a limited period at no charge. These codes are not subscriptions, do not renew, do not require a payment method, and expire on their own. They have no cash value, cannot be resold, and we may revoke access granted in error or obtained through misuse.

6. Acceptable use

You agree not to use Alpen to:

• Create or distribute unlawful, infringing, or harassing material
• Create sexual content involving minors, or any content that sexualises or endangers children
• Circumvent the free tier, subscription gating, or access-code system
• Interfere with the operation or security of Alpen or our services

7. Accounts

You may use Alpen without an account. If you create one via Sign in with Apple, you are responsible for activity under it. We may suspend or terminate accounts that breach these Terms. See our Privacy Policy for what account data we hold.

8. Availability and changes

We may modify, suspend, or discontinue Alpen or any feature at any time. We will make reasonable efforts to give notice of significant changes. Preset and template libraries may change as content is added or, occasionally, retired.

9. Disclaimers

Alpen is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Alpen will be uninterrupted or error-free.

Keep your originals. Alpen is a non-destructive editor and does not modify your original photos or videos, but you are responsible for backing up your photo library.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability arising out of or relating to these Terms or Alpen will not exceed the greater of the amount you paid us in the twelve months before the claim, or USD 50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination

These Terms apply until terminated. You may terminate by deleting Alpen and any account. We may terminate or suspend access if you materially breach these Terms. Sections 2, 3, 9, 10, and 12 survive termination.

12. Governing law

These Terms are governed by the laws of the State of Virginia, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Montgomery County, Virginia, and you and we consent to their jurisdiction. Nothing here removes consumer rights that cannot be waived under the law where you live.

13. Apple

The following apply because Alpen is distributed through the App Store:

• Acknowledgement. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for Alpen and its content.
• Scope of licence. The licence in section 1 is non-transferable and limited to Apple-branded products you own or control, as set out in the App Store Terms of Service Usage Rules.
• Maintenance and support. We are solely responsible for maintenance and support. Apple has no obligation to provide any.
• Warranty. We are solely responsible for any product warranties, express or implied, to the extent not effectively disclaimed. If Alpen fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
• Product claims. We, not Apple, are responsible for addressing any claims relating to Alpen, including product liability claims, any claim that Alpen fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
• Intellectual property. If a third party claims that Alpen infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Contact. Questions, complaints, or claims should be directed to VegaHouse LLC, 155 Clearview Drive, Christiansburg, VA 24073, USA, support@getalpen.app.
• Third-party terms. You must comply with applicable third-party terms when using Alpen.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

14. Changes to these Terms

We may update these Terms. Material changes will be reflected in the date above and, where appropriate, notified in the app. Continued use after changes take effect means you accept them.
